Service Agreement for the Hire of Equipment

1. Parties

This Service Agreement (“Agreement”) is entered into between Baby Concierge (“Supplier”, “we”, “us”, “our”) and the customer/hirer (“Customer”, “you”, “your”) for the hire of baby and toddler equipment (“Equipment”).

2. Ownership of Equipment

2.1 All Equipment hired under this Agreement remains the sole property of Baby Concierge at all times.

2.2 The Customer is granted a limited right to use the Equipment strictly for the agreed hire period.

2.3 The Customer shall not sell, lend, sub-hire, or otherwise dispose of the Equipment to any third party.

3. Hire Period

3.1 The hire period shall commence on the date specified in the booking confirmation, which may be the date of delivery, collection, or a pre-arranged start date.

3.2 The hire period shall terminate on the final day specified in the booking confirmation (“Return Date”).

3.3 The Customer is responsible for ensuring the Equipment is returned, collected, or made available for pickup on the Return Date, unless otherwise agreed in writing.

4. Pricing and Payment

4.1 All prices are as displayed on the Supplier’s website and are inclusive of VAT (where applicable).

4.2 Payment in full is required at the time of booking via the Supplier’s secure payment system.

4.3 Additional charges may apply for extended hire periods, late returns, damage, or loss of Equipment.

5. Order Confirmation and Stock Availability

5.1 A booking is confirmed only upon receipt of an email confirmation from the Supplier, which will detail the Equipment hired, hire dates, and delivery or collection method.

5.2 The Supplier does not guarantee availability of Equipment until the booking is confirmed.

5.3 In the event that an item becomes unavailable after confirmation, the Supplier will offer an alternative item or a full refund.

6. Delivery and Returns

6.1 The Customer may collect Equipment in person from the Supplier’s designated location, providing the Customer delivers valid identification and an order confirmation.

6.2 Where selected, the Supplier will deliver and set up Equipment within the agreed time slot or arrange for courier delivery (at additional cost to the Customer).

6.3 The Customer must ensure someone is present to receive courier deliveries.

6.4 Returns must be made in accordance with the method specified in the booking confirmation (collection point, concierge pickup, or courier collection).

6.5 The Customer must ensure all Equipment is clean and securely packed for return.

7. Changes, Cancellations, and Refunds

7.1 All pre-payments are non-refundable.

7.2 If the Customer notifies the Supplier at least seven (7) days before the hire start date, the Customer may:
(a) reschedule the booking once to another date within twelve (12) months of the original hire start date;
(b) Amend the hire (change items or dates), subject to availability;
(c) All changes are subject to a £10 administration fee.

7.3 Cancellations or changes within seven (7) days of the hire start date are not eligible for refund or reschedule, unless otherwise agreed by the Supplier.

7.4 Early return of Equipment does not entitle the Customer to a refund for unused hire time.

8. Late Returns and Non-Returns

8.1 The Customer remains responsible for the Equipment, and charges will continue to accrue, until the Equipment is returned to the Supplier.

8.2 Late returns will incur a fee of £25 per item per day ("Late Return Fee"), commencing the day after the original Return Date. Items returned half a day late will incur the full Late Return Fee.

8.3 If Equipment is not returned, the Supplier reserves the right to take all necessary steps, including legal action or involving law enforcement, to recover its property.

9. Care, Damage, and Loss

9.1 The Customer shall use the Equipment with due care and in accordance with any instructions provided.

9.2 The Customer must, as soon as reasonably practicable, notify the Supplier (in writing) of any damage, malfunction, or loss of Equipment.

9.3 The Customer may be liable for the cost of repair or replacement in the event of significant damage, misuse, or loss, as determined by the Supplier, in its sole discretion.

9.4 General wear and tear is expected; however, misuse or neglect may result in additional charges.

10. Insurance and Waivers

10.1 The Equipment is not insured under this Agreement.

10.2 The Customer is advised to check their own home or travel insurance for coverage.

10.3 Damage waiver options may be available for certain products at checkout.

11. Limitation of liability

11.1 The Supplier is responsible for providing safe, well-maintained Equipment that meets UK safety standards.

11.2 The Customer is responsible for the Equipment during the hire period and for its safe use.

11.3 The Supplier shall not be liable for any accident, injury, or loss arising from misuse of the Equipment.

11.4 The Supplier shall not be liable for indirect loss, inconvenience, or issues outside its control, including third-party courier delays.

12. Termination

12.1 The Supplier reserves the right to terminate this Agreement immediately if the Customer breaches any term, including but not limited to misuse of Equipment or non-payment.

12.2 The Customer may terminate the Agreement early by providing not less than [7] days' notice, subject to the cancellation policy in Clause 7.

13. Assignment

13.1 The Customer may not assign, transfer, or sub-contract any rights or obligations under this Agreement without the Supplier’s prior written consent.

14. Governing Law and Jurisdiction

14.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

14.2 Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

15.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

16.1 This Agreement, together with the booking confirmation, constitutes the entire agreement between the parties and supersedes all prior agreements whether oral or written.

17. Amendments

17.1 The Supplier may amend these terms from time to time.

17.2 The Customer shall be notified as soon as reasonably practicable of any significant changes affecting their booking.

19. Defamation and Libel

19.1 The Supplier welcomes honest feedback. However, false or harmful public statements that damage the Supplier’s reputation may result in legal action.

By placing a booking with Baby Concierge, the Customer acknowledges and agrees to be bound by the terms and conditions set out in this Agreement.
